Establishment ACT of Iranian Fisheries Organization

Private bill- Iranian Fisheries Organization (hereafter "the Organization") as a public organization affiliated to the Ministry of Jehad Agriculture is thereby established in order to conserve and protect the aquatic resources in the territorial waters under the sovereignty and jurisdiction of the Islamic Republic of Iran and to enforce both the provisions cited in the "Conservation and Exploitation Act of the Iranian Aquatic Resources" adopted in 5th, September 1995 (15th ,Shahrivar,1374, in Iranian Calendar) and any other rules pertinent to the responsibilities of the Organization.
Note 1- Authoritative responsibilities of the Organization are subject to the "Conservation and Exploitation Act of the Aquatic Resources" of the I. R. of Iran adopted in, 5th, September, 1995(15th, Shahrivar, 1374, in Iranian Calendar).
Note 2- Iranian Fisheries Company along with its affiliated companies is thereby liquidated since 21st, May, 2005 (the first day of 1384, in Iranian Calendar) and all the sovereignty, responsibilities, obligations, facilities, property and staff pertinent to the assigned duties are transferred to the Organization.
Note 3- To perform the bestowed obligations the Organization shall be authorized to make necessary measures with regard to putting into sale its surplus property and facilities. Being remitted to the Treasury account, the whole sum (%100) shall be returned back to the Organization subject to the annual budget rules so that it can fulfill the obligations.
Note 4- The Organization shall be authorized to open representative offices only in the coastal provinces.
Note 5- All executive activities and operations on fishing, fish processing, marketing and exploitation of sturgeon fish along with the respective facilities, goods, property, and staff are thereby transferred to "Agriculture Service Mother Professional Company" and equal value of the belonging goods, facilities and property shall be added to the assets of the Company.
Note 6- Any income induced from caviar sale shall be remitted to the Treasury account.
Note 7- Iranian Management and Planning Organization is committed to consider the required funds by the Organization specifically in the National Budget Act.
Note 8- In terms of administrative, financial and employment rules, the Organization shall be subject to those of the Ministry of Jehad Agriculture.

Note 9- The Ministry of Jehad Agriculture is required to develop the Organization's Charter within six months in coordination with Iranian Management and Planning Organization and have it adopted by the Cabinet.
Note 10- The president of the Organization shall be entitled Deputy Minister of Jehad Agriculture.
Composed of one private bill and ten notes, the Act was adopted in the public session of the Islamic Council Assembly (Legislative Assembly) on Wednesday ,19th May, 2004, and was approved by the Constitution Guardian Council on
Saturday,29th , May, 2004 .
